2. Our Order Process and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
This means that when you purchase a course, your payment transaction is with Paddle (Paddle.com Market Ltd) as the seller/reseller of record, while Pilot Audio Pty Ltd provides and licenses the course content to you under these Terms. By completing a purchase, you also agree to Paddle's Buyer Terms and Refund Policy, available at paddle.com. Paddle is responsible for processing your payment, calculating and remitting applicable taxes, issuing your receipt, and handling refunds and chargebacks. We never receive or store your full payment-card details.
This means that when you purchase a course, your payment transaction is with Paddle (Paddle.com Market Ltd) as the seller/reseller of record, while Pilot Audio Pty Ltd provides and licenses the course content to you under these Terms. By completing a purchase, you also agree to Paddle's Buyer Terms and Refund Policy, available at paddle.com. 3. The Services
3.1 We provide digital aviation theory courses, including audiobook content, audio practice exams, a written practice question bank, and printable workbooks, delivered through an online learning platform and a private podcast feed.
3.2 Our courses are educational study aids designed to help you prepare for the FAA Private Pilot Knowledge Test and the knowledge areas of the FAA Airman Certification Standards. We do not guarantee that completing a course will result in you passing the FAA Knowledge Test, the practical test (checkride), or any other examination. Outcomes depend on many factors, including your individual preparation, your flight training, and the ground instruction and endorsements provided by your instructor.
3.3 We are not an FAA-certificated flight or ground school, and we are not a Part 141 or Part 142 training provider. Our courses are supplementary study resources and do not constitute formal flight training, ground instruction, or an instructor endorsement. Only an appropriately certificated flight or ground instructor can provide the endorsement required to take the FAA Knowledge Test.
3.4 Nothing in our courses constitutes legal, regulatory, medical, or professional advice. Always verify safety-critical and regulatory information against current FAA publications and the current Federal Aviation Regulations.

4. Accounts
4.1 To access our Services, you must create an account on our learning platform. You agree to provide accurate information when creating your account and to keep your details up to date.
4.2 You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you believe your account or your private podcast feed has been accessed without your permission, contact us immediately at support@pilotaudiousa.com.
4.3 Your access to purchased course content is personal to you. Your private podcast feed link and your course logins are for your individual use only and must not be shared (see Section 8).
4.4 We reserve the right to suspend or terminate your account if we reasonably believe you have breached these Terms.

5. Pricing, Orders, and Payment
5.1 Prices for our Services are displayed on the Website in US dollars. Applicable sales tax is calculated and added at checkout by Paddle based on your billing location, so the final amount charged may be higher than the listed price.
5.2 When you place an order, you are making an offer to purchase. A binding agreement is formed when your payment is confirmed and Paddle sends you a confirmation of your transaction.
5.3 Payment is processed at the time of purchase through Paddle. On successful payment, your enrollment is provisioned automatically, and access to your course and your private podcast feed is provided shortly after.
5.4 Your purchase provides 12 months of access to the course from the date of purchase. This is a one-time payment. It is not a subscription, and you will not be billed again or on a recurring basis for the same course.
5.5 We reserve the right to change prices at any time. Price changes do not affect orders that have already been confirmed.

6. Refund Policy
Because Paddle is our Merchant of Record, refunds are processed by Paddle in accordance with the policy below and Paddle's own Buyer Terms. You may request a refund by contacting us at support@pilotaudiousa.com, or by contacting Paddle directly via paddle.net. 6.1 14-day money-back guarantee. You may request a full refund within 14 days of purchase, for any reason. This applies without exception or condition — you are entitled to a refund within this window regardless of whether or how much of the course content you have accessed.

If a course has a material fault — for example, significant portions of content fail to load, audio is corrupted, or the course is materially different from what was described — you may be entitled to a replacement or refund even after the 14-day period. Please contact us with as much detail as possible and we will work to resolve the issue promptly. If we cannot resolve a genuine fault, a full refund will be provided.
6.5 No pass guarantee. Separately from the 14-day guarantee above, we do not offer a "pass or refund" guarantee. Not passing the FAA Knowledge Test or any examination is not, by itself, a basis for a refund outside the 14-day window.
6.6 Your statutory rights. Nothing in this refund policy limits any rights or remedies you may have under applicable consumer-protection law that cannot be waived or excluded, including for products that are faulty or not as described.

9.1 We make every reasonable effort to keep our course content accurate and aligned with the current FAA Airman Certification Standards, the Federal Aviation Regulations, and current FAA publications (including the Pilot's Handbook of Aeronautical Knowledge, the Airplane Flying Handbook, and the Aeronautical Information Manual).

These Terms, together with our Privacy Policy and Cookie Policy, and (for the payment transaction) Paddle's Buyer Terms, constitute the entire agreement between you and Pilot Audio Pty Ltd in relation to your use of the Website and Services, and supersede all prior agreements and representations.
18. Governing Law
These Terms are governed by the laws of Queensland and the Commonwealth of Australia, without regard to conflict-of-laws principles. This does not deprive you of the protection of any mandatory consumer-protection laws of the place where you live. You and Pilot Audio Pty Ltd submit to the non-exclusive jurisdiction of the courts of Queensland, Australia, and any courts entitled to hear appeals from them.
